The petitioner seeks anticipatory bail in connection with Bithan P.S. Case No. 19 of 2014, registered for offences punishable under Section 365 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor son of the informant.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and earlier he remained in Ambala jail custody. It is further submitted that the statement of the victim boy recorded under Section 164 Cr. P. C., in which the victim boy has stated the name of the petitioner and also stated that upon proceeding to Ambala, the police has sent to

Patna High Court Cr.Misc. No.34943 of 2018 (2) dt.05-07-2018 2/2 the petitioner in jail.

Learned A.P.P. opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner.

With the aforesaid observation, this application is dismissed.
