The petitioner apprehends his arrest in a case registered for the offence under Section 304B/34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other family members caused death of daughter of informant. It is submitted on behalf of petitioner that petitioner is father-in-law of deceased and has got no concern with the affairs of the deceased. In fact, she caught fire while she was cooking and in spite of steps taken to save her life, she could not be saved. The family members of deceased took part in funeral of deceased and in their presence, she was cremated and as such, no case under Section 304(B) of the I.P.C. is made out against petitioner.

Patna High Court CR. MISC. No.65457 of 2021(3) dt.06-07-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific and direct allegation against this petitioner that he alongwith other family members killed the daughter of informant by burning.

Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
