Petitioner in this case has challenged the order taking cognizance and issuance of summons passed by the learned Chief Judicial Magistrate, Gaya on 29.10.2018 in Rampur P.S. Case No.289 of 2018.

On perusal of the allegations made in the FIR it appears that there are specific allegations against this petitioner and several instances of committing overt act of torture and cruelty against opposite party no.2. Police has investigated the case and has filed a charge-sheet based on which the learned C.J.M., Gaya has taken cognizance and issued summons.
