Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioner are alleged to have assaulted Hasib by bricks and stones. It is further alleged that petitioner No. 3 snatched Rs. 40,000/- from the pocket of Sabbir Alam, brother-in-law of the informant. Learned counsel appearing for the petitioners submits that specific accusation of assault is against other co-accused persons. So far these petitioners are concerned there is general

Patna High Court CR. MISC. No.65138 of 2021(4) dt.17-10-2022 2/2 and omnibus allegation of assault against them. Hasib sustained simple injuries. Petitioners are ladies and have got clean antecedent.

Learned counsel appearing for the State and the informant vehemently opposed the prayer for anticipatory bail and submitted that petitioners also actively participated in the alleged occurrence.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateI, Bhojpur, Ara in connection with Bihia PS case No. 289/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
