Petitioner seeks bail in a case registered under sections 395, 397 and 412 of the Indian Penal Code.
Taking into consideration that petitioner made his absent before the trial court when attendance of a prosecution witness was filed and petitioner remained absent for near about ten years, I am not inclined to release him on bail and accordingly, his prayer for bail in connection with Bakhtiyarpur Rail P.S. Case no. 23/2004 arising out of Sessions Trial no. 75/2005 pending in the court of the Addl. Sessions Judge I, Barh, Patna stands rejected. However, the learned court below is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/production of a copy of this order, failing which the petitioner may renew is prayer for bail before the trial court itself.
