The petitioner seeks bail in connection with Vaishali (O.P. Belsar) P.S. Case No. 523 of 2024 instituted for the offence under Section 87 of the Bharatiya Nyaya Sanhita, 2023.

Prosecution story, in short, is that petitioner allegedly kidnapped the daughter of the informant on the point of pistol. It is further alleged that when the informant visited the house of petitioner, his parents threatened her to kill her daughter if she makes noise.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.12.2024. Petitioner

Patna High Court CR. MISC. No.58738 of 2025(3) dt.26-09-2025 2/3 bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that victim girl is a major girl and fled away from her house according to her own sweet will to marry with the petitioner, since they were in love affairs. Victim has refused for her medical examination. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Referring to the statement of the victim recorded under Section 183 of the BNS, 2023, it is submitted that victim has supported the prosecution case. Charge sheet has already been submitted in this case under Sections 137(2), 87, 64, 126(2), 115(2), 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. 7.

Considering the aforesaid facts and circumstances of the case and specifically taking into account the fact that victim has supported the prosecution case in her statement recorded under Section 183 of the BNSS, 2023, this Court is not inclined to grant bail to the petitioner. Prayer for grant of bail to the petitioner is hereby rejected.

The Trial Court is directed to expedite the trial as
