JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302 and 201/34 of the Indian Penal Code. Petitioner is named in the first information report on the accusation that he established illicit relation with co-accused Sunita Devi and having entered into conspiracy Sunita Devi and petitioner committed the murder of informant's father. The informant claimed that earlier his father had kept Sunita Devi as his wife and has transferred some lands in her favour, but subsequently, when Sunita Devi established illicit relation with petitioner, the informant's father made protest as a result of which he was killed by the petitioner and co-accused Sunita Devi. Patna High Court Cr.Misc. No.12362 of 2016 (2) dt.18-03-2016 2/2 seen the actual killing of the deceased and except suspicion, there is nothing against the petitioner. It is further submitted that moreover, co-accused Sunita Devi has already been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 3.3.2016 passed in Cr. Misc. No.1760 of 2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Darbhanga in connection with Baheri P.S.
