2. The petitioner is apprehending his arrest in a case registered in connection with Bihta P.S.Case No. 1357 of 2018 for the offence punishable under Sections 304(B), 341,324,326,307/34 of the Indian Penal Code and section 3⁄4 of Dowry Prohibition Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw the bail application.

4. Permission is accorded.

5. Accordingly, the present bail application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned court below within six weeks from today and seeks regular bail, the learned court below shall pass order preferably

Patna High Court CR. MISC. No.56322 of 2023(2) dt.15-09-2023 2/2 on the same day without being prejudiced by this order considering the fact that the other co-accused persons have been acquitted in the trial.
