The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 341, 323, 353 and 147 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 26.25 litres of IMFL was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 8.4.2022 (Annexure-1) passed in Cr. Misc. no. 61029 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 5.9.2021.

Heard learned APP for the State.

No.56234 of 2022(2) dt.16-11-2022 2/2 Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order dated 8.4.2022 together with the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Sakra P.S. Case no. 290 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court no. 1, Muzaffarpur.
