2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 3(5) of BNS.

3. Considering the nature of allegation alleged in the FIR, this Court is not inclined to extend the privilege of anticipatory bail to the petitioner as it has been alleged by the informant that the petitioner in an intoxicated condition restrained the informant and was adamant upon to assault him on 26.10.2024. Thereafter on 27.10.2024, the petitioner again misbehaved with the informant and on 28.10.2024, when the informant was returning home on his bike when petitioner along with his friend Satya overtook him by their bike and Satya

Patna High Court CR. MISC. No.54470 of 2025(2) dt.25-08-2025 2/2 assaulted the informant by brick while petitioner stabbed the informant in his abdomen causing injury.

4. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case by the Informant. It is next submitted that the FIR has been instituted after delay of one day and the informant was admitted in a private hospital.

5. Learned A.P.P. opposes the anticipatory bail application and submits that there is specific allegation against the petitioner of stabbing the informant causing injury in his abdomen. It is also submitted that investigation of case is at initial stage and if the privilege of anticipatory bail is granted to the petitioner, the petitioner may abscond.

6. As such, the anticipatory bail of the petitioner is rejected.
