Petitioners are doctors, who are working under Patna University. They are employees of the University. However, they are seeking relief at par with members of the Bihar Health Service in matter of grant of Dynamic ACP. The crux of the argument of
Patna High Court CWJC No.812 of 2015 dt.07-10-2015 2/2 learned counsel for the petitioners is that in terms of Annexure- 15, dated 25.2.1987, there was some kind of agreement worked out between the striking employees of the University and the State and the State Government has issued this notification. This notification has been held to be binding between the employees and the State as per a decision by the Hon'ble Supreme Court rendered in the case of State of Bihar v. Sunny Prakash, reported in (2013) 3 SCC 559. Keeping the above proposition in mind, writ is disposed of with a direction upon the Principal Secretary, Education Department, Government of Bihar as well as the Principal Secretary, Department of Finance to consider and take a decision preferably within a period of four months from the date of production of a copy of this order.
