JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-05-2016 Heard the learned counsel for the petitioner and the learned A.P.P representing the State.
The petitioner seeks bail in connection with Warisnagar P.S. Case No. 207 of 2015 registered for the offences punishable under Sections 341, 323, 307, 504 and 302 of the Indian Penal Code.
Allegedly, Bhuttu Sahni, the father of the informant was assaulted by the petitioner with piece of bamboo on 25.10.2015 with an intention to kill him resulting he became injured. During investigation, the father of the informant died on 26.10.2015 during treatment.
Submission is of false implication and that there was no intention to commit the murder, the occurrence has taken place
Patna High Court Cr.Misc. No.14449 of 2016 (3) dt.13-05-2016 2/2 on account of urinating in front of house of the petitioner, the father of the informant was not brought to the P.M.C.H and he was treated by private doctor where he died. He was aged of 72 years and as such the petitioner suffering in custody since 06.12.2015 deserves sympathetic consideration.
The learned A.P.P opposes the prayer of the bail. In the facts and circumstances stated above, considering the allegation attributed against the petitioner, serious in nature, I am not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Warisnagar P.S. Case No. 207 of 2015 pending in the Court of learned Chief Judicial Magistrate, Samastipur. However, considering the detention of the petitioner, let the trial be expedited and concluded preferably within nine months from the date of receipt or production of a copy of this order.
