This application for anticipatory bail arises out of Bagaha (Patkhauli) P.S. Case No. 217 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 379, 307, 302 and 506 of the Indian Penal Code.

The petitioner is the father of co-accused Bittu Yadav, who is said to have assaulted the informant and was carrying a dagger.

It is alleged that the co-accused Bhola Pahalwan after having taken the dagger from the said Bittu Yadav, had assaulted the informant's son, leading to grievous injury. Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner has been implicated

Patna High Court CR. MISC. No.51763 of 2019(2) dt.20-08-2019 2/2 only because he is the father of the co-accused Bittu Yadav, who was allegedly carrying a dagger with him. He has also submitted that there is no specific allegation against the petitioner of assault.

Considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned ACJM 1st Class, Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S.Case No. 217 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
