JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,307,447 and 504 of the Indian Penal Code.
It is alleged that the informant was assaulted when informant's son and others came to rescue, they were also assaulted.
It is submitted by the learned counsel for the petitioners that the FIR was lodged against twelve persons when petitioners were not sent up for trial but subsequently differing with the final form cognizance was taken against the petitioners
Patna High Court Cr.Misc. No.30695 of 2014 (3) dt.19-03-2015 2/2 also. There is counter version of the occurrence also. Considering the fact that the accusation against the petitioners was not found true during investigation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Assaon P.S. Case No. 63 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
