JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-366A, 376, 312/34 of the Indian Penal Code. The statement of victim was recorded u/S 164 of the Cr.P.C. in which, she stated that she was, forcibly, taken away by the petitioner to Lucknow, where she was confined for 7 days but subsequently, when she pressurized, she was brought by the petitioner to Sugauli, where she was dropped. The victim has been found between 17 1⁄2 to 18 1⁄2 years in her medical examination. Contention on behalf of the petitioner is that there were love affairs between the parties and as a matter of fact, the

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Motihari Muffasil P.S. Case No. 193 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran.
