JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 307, 353 of the Indian Penal Code and Section 27 of the Arms Act.

Co-accused, Md. Mahboob was caught and Rs.

3000/- looted amount was recovered from his possession. The aforesaid apprehended co-accused disclosed the name of the petitioner and others and except the aforesaid material as well as criminal antecedent, there appears to be nothing against the petitioner. Moreover, co-accused, Md. Mahboob has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 18.01.2016 passed in Cr. Misc. No. 47289 of 2015.

No.11641 of 2016 (2) dt.16-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 149 of 2015.
