The petitioner seeks bail in a case registered under Sections 341, 323, 379, 324, 307, 504/34 of the Indian Penal Code.
Allegation against the petitioner is that he took out khukhari from his waist and gave blow on informant's head, as a result of which his head become injured and blood was oozing out.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.06.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the
Patna High Court CR. MISC. No.51700 of 2019(2) dt.20-08-2019 2/2 parties. The injuries on the side of the accused persons have not been explained by the prosecution. The prosecution has not come with clean hands. There is title suit also pending between the parties.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, District Darbhanga in connection with Biraul P.S. case No.305 of 2016.
