The counsel for the Bihar Education Project Council submits that this petition has rendered infructuous on account of efflux of time, as the matter relates to appointment of the District Programme Officer, (Prathmik Shiksha and Sarva Shiksha Abhiyan), West Champaran which is not a statutory post, but the arrangement has been made for improvement/advancement of the Education and that post cannot be vested right, it is always a rotational appointment.

This Court does not find any purpose to keep this matter pending.
