The petitioner apprehends his arrest in Chausa(Fulout O.P) P.S. Case No.376 of 2017 registered under Sections 341, 323, 385, 354(A), 379, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that while she along with her husband irrigating her wheat crop the accused persons came and made protest. The accused persons assaulted the informant and her husband and also took out Rs.3500/- from the pocket of the husband of the informant.

The learned counsel for the petitioner submits that petitioner is co-sharer of the husband of the informant. There is land dispute between two sides. The land of the petitioner is

No.33979 of 2018 (2) dt.28-06-2018 situated adjacent to the land of the informant on which the informant was irrigating but they had also encroached upon the land of the petitioner that is why some altercation took place. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner happens to be co-sharer of the husband of the informant, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Uda Kishunganj, DistrictMadhepura in connection with Chausa(Fulout O.P) P.S. Case No.376 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
