Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Raj Kishore Prasad, Adv. For the Opposite Party/s : Mr. Bisheshwar Ram, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Manpur P.S.Case No. 115 of 2017 registered under Sections 290, 291, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Considering the allegation made in the FIR and the observation made by the learned Sessions Judge in the order rejecting pre-arrest bail of the petitioner from which it will appear that the petitioner opened fire causing injury to a 12 year old girl on her thigh, who was first being treated at Biharsharif and subsequently referred to P.M.C.H. for further treatment, I am not inclined to grant him pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.

Patna High Court Cr.Misc. No.35340 of 2018 (2) dt.28-06-2018 2/2 In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
