The petitioner is languishing in custody for the offences punishable under Sections 414/120B of the Indian Penal Code and Sections 25(1-b)a/26(ii)/35 of the Arms Act. Seven persons were apprehended from a room. Fire-arm and cartridges were recovered from the possession of co-accused. Nothing was recovered from the possession of the petitioner. However, petitioner stated before the police that he had come there to make payment for the liquor supplied. Submission is that similarly situated co-accused Pawan Kumar has been allowed bail by a co-ordinate Bench of this Court in Cr. Misc. No.50682 of 2019.

No.50874 of 2019(2) dt.22-08-2019 2/2 Considering the facts aforesaid as well as completion of investigation against the petitioner and the statement of the petitioner that he has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Muzaffarpur Sadar P.S. Case No.403 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
