No doubt, the petitioner does have criminal antecedent of near about five cases but in the present case nothing was recovered from his conscious possession and, according to prosecution case itself, petitioner and two others were coming on a motor cycle but met with an accident and after that the petitioner was caught by the police whereas his two associates managed to flee away.

Considering the facts of the present case and submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten
