ANJANA MISHRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Trial No.2435/13 arising out Majhaulia P.S. Case No.269 of 2003 for the offence under Sections 409, 120B and 34 of the I.P.C. It is submitted that the police has submitted final form in this case as way back as in the year vide charge sheet No.308 of 2004 dated 29.12.2004. However, the learned Magistrte while differing from the finding had taken cognizance in this case and, thus, the petitioner is apprehending his arrest. It is further submitted that the co-accused persons having similar allegations have already been extended the privilege of anticipatory bail by a coordinate Bench vide order dated 2.5.2014 passed in Cr.Misc. No.9716 of 2014.

No.32413 of 2014 (3) dt.21-01-2015 2/2 Considering the aforementioned submissions let the petitioner, above named, in the event of his arrest or surrender before the court below within two weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Ajay Kumar, J.M., Bettiah, West Champaran, in Trial No.2435 of 2013 arising out of Majhaulia P.S.Case No.269 of 2003 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
