====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-10-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State (in both cases) and learned counsel for the informant.
2. The petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.53743 of 2025(3) dt.14-10-2025 2/3 registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 352 and 351(2)(3)of the B.N.S. and later on, Section 103(2) of B.N.S. was added.
3. The Informant has alleged that on 31.03.2025 at about 2 PM, all the F.I.R. named accused persons including petitioners were constructing house on the way of informant's house and when informant's wife protested, all the accused persons brutally assaulted brother, wife and son of the informant. They also snatched gold & silver ornaments from informant's wife. Subsequently, brother of informant (Gopal Paswan) succumbed to his injuries.

Learned counsel for the petitioners submits that sudden quarrel took place between the parties with regard to dispute over pathway, in which, there is general and omnibus allegation against these petitioners. As per F.I.R., four persons are alleged to have assaulted the deceased, but as per postmortem report, only one injury was found on the head of deceased, who died during course of treatment and thus, the post-mortem report does not corroborate the allegation made in the F.I.R. So far as injuries, sustained by informant's wife and son are concerned, they are simple in nature. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State (in both case) and learned counsel for the informant vehemently opposed both the bail petitions.
6. Considering the aforesaid facts and circumstances, let the above named petitioners (in both bail petitions), in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Katihar in connection with Barari P.S. Case No. 91 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
