JUSTICE VIKASH JAIN ORAL ORDER 17-04-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The present petition has been filed for quashing the F.I.R. of Kishanganj P.S. Case No. 436 of 2013 under Sections 406, 420, 323, and 504 of the Indian Penal Code and to initiate a fair investigation in the instant case.
3. It is submitted that the complaint (subsequently converted into the instant F.I.R.) has been filed only to harass the petitioner who in fact had earlier lodged Kishanganj P.S. Case No. 214 of 2013 against the complainant/informant.
4. Be that as it may, learned counsel for the
Patna High Court Cr. WJC No.693 of 2014 (3) dt.17-04-2015 Respondent No. 5 makes statement that investigation has since been concluded by the police and chargesheet no. 273 of 2014 has already been submitted against the accused.
5. Having regard to the statement made on behalf of Respondent No. 5 to the effect that investigation has already been concluded, this Court is not inclined to quash the F.I.R. and the writ petition stands disposed of.
