KUMAR ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 30(a) of the Bihar Excise (Amendment) Act, 2016. Allegation against the petitioner is that one Mukendra Kumar, who was apprehended while carrying foreign liquor in a Tata Indigo vehicle, disclosed his (petitioner) name on confession. It has been submitted on behalf of petitioner that he has got no criminal antecedent. Due to inimical terms co-accused Mukendra Kumar has disclosed his (petitioner) name in his confessional statement. Petitioner is in custody since 26.4.2017. It is further submitted that co-accused Rahul Kumar has been granted bail by a Bench of this Court in Cr. Misc. no. 11084 of 2017.

Considering the facts and circumstances of the present case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge, Aurangabad, in
