The petitioner seeks bail in Sadar P.S. Case No. 403/2019, instituted for offence under Section(s) 414, 120(B) of the Indian Penal Code read with Sections 25(1-b)a, 26(ii) and 35 of Arms Act.

Learned counsel for petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner.

It is alleged in the written report that police got confidential information that Chunnu Thakur and Ravi Master are doing business of illicit liquor by making a syndicate/module in the rented house of co-accused Rajeev

Patna High Court CR. MISC. No.50682 of 2019(2) dt.17-08-2019 2/2 Kumar @ Ravi Master. On such information raid was conducted in the rented house of Rajeev Kumar where seven persons were found present, including the petitioner. Police made search but no recovery was made from possession of petitioner. It is alleged that petitioner had come to book the wine. Petitioner is in custody since 13.06.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 403/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
