Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.
Petitioner is not named in the first information report but in course of investigation, the stolen tractor was recovered from khalihan of the petitioner on 23.12.2015. Subsequently, one co-accused, Veeru Kumar @ Sushil Rai was arrested and named the petitioner.
Submission on behalf of the petitioner is that the alleged recovery was made in absence of the petitioner and the seizure list does not bear the signature of the petitioner. It is
Patna High Court Cr.Misc. No.14049 of 2016 (2) dt.05-04-2016 2/2 further submitted that petitioner was not aware about the said recovery and he came to know about the present case when he was arrested by the police.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, Judicial Magistrate 1st Class, Patna City, Patna in connection with Didarganj P.S.
