JUSTICE VIKASH JAIN ORAL ORDER 25-03-2015 Heard learned counsel for the petitioner and learned APP for the State assisted by learned counsel for the opposite party no.2

2. The petitioner apprehends his arrest for the offences alleged under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act registered in connection with Complaint Case No. 643C/ 2013.

3. It is submitted that the petitioner has been falsely implicated and this is the first such grievance raised since the parties were married two year ago. The petitioner expresses his willingness to keep the opposite party no. 2 with due dignity and honour.

4. Learned counsel for the opposite party no. 2 appears and also expresses willingness on her part to

5. Pursuant to order dated 10.03.2015, both parties are personally present and agree that they would be leaving the Court premises together, reiterating their commitment to resume their conjugal life in harmonious manner.

6. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the petitioner (Saryug Chaurasiya) be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Khagaria in connection with Complaint Case No.643C/2013, subject to the conditions as laid down under Section (2) Cr.P.C.

However, in case a fresh complaint/F.I.R. of similar nature is filed by the opposite party no. 2 against the petitioner at any time prior to conclusion of the trial, the anticipatory bail granted to the petitioner shall stand automatically cancelled.
