JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2017 This application has been filed for restoration of Criminal Miscellaneous No. 23189 of 2017, which has been dismissed for non compliance of order dated 11.05.2017, passed in this Case, by which petitioner was directed to remove the defect pointed out by the Stamp Reporter in course of day.

Learned counsel for petitioner submitted that due to circumstances beyond his control, he could not remove the defect and could not file the prosecution report within the prescribed time and submitted that he will file the prosecution report by tomorrow and prayed that the Criminal Miscellaneous No. 23189 of 2017, be restored.

In view of the fact stated in the restoration application and also in view of the submission, this application is allowed, let Criminal Miscellaneous No. 23189 of 2017, be restored to its original file.
