JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but when the statement of victim was recorded under section 164 of the Cr.P.C. , victim stated about the participation of the petitioner in the alleged crime.

The contention on behalf of the petitioner is that the victim was in love with Md.Tahir and earlier, she had eloped with the aforesaid Md. Tahir and the informant of the present case had lodged Purnahiya P.S.Case No. 03 of 2016 and again victim eloped with Md.Tahir but the informant persuaded the victim to implicate the petitioner and others in the present case, as a result where of, victim stated the involvement of the petitioner in the alleged crime.

Patna High Court Cr.Misc. No.12621 of 2016 (2) dt.28-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sheohar in connection with Purnahiya P.S.Case No.7 of 2016.
