ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.07.2019 in connection with Aurangabad Muffasil Excise Case No.731 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries of 1000 litres of illicit country made liquor were made from the car in which the petitioner was travelling and not from his conscious possession. It is further submitted that neither the petitioner is the driver nor the owner of the vehicle and he has clean antecedents.

Considering the aforementioned facts and

No.55650 of 2019(2) dt.04-09-2019 2/2 circumstances and that the petitioner has clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge Cum Special Judge, Excise, Aurangabad, in connection with Aurangabad Muffasil Excise Case No.731 of 2019.
