JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bhojpur Mahila P.S.Case No. 12 of 2014 registered for the offences punishable under Sections 323, 498A, 504/34 of the Indian Penal Code.

Petitioner happens to be the husband and his specific stand is that he is still ready to keep the complainant with full honour and dignity but the complainant herself does not want to lead her conjugal life with the petitioner.

It is pointed out on behalf of the petitioner that learned

Patna High Court Cr.Misc. No.32268 of 2014 (2) dt.06-02-2015 2/3 Session Judge, Bhojpur at Ara had also issued notice to the complainant but even after having received the notice, she did not appear before the learned Sessions Judge, Bhojpur at Ara. In view of the aforesaid submissions as well as facts and circumstances of the case, this anticipatory bail petition stands disposed of with direction to the petitioner to surrender and seek regular bail before the court of Chief Judicial Magistrate, Bhojpur at Ara/ concerned court within six weeks from the date of receipt / production of copy of this order and if, petitioner does so, the concerned court shall release the petitioner on provisional bail for the period of four months on furnishing bail bonds of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of the concerned court on the date of his surrender and after releasing the petitioner, the concerned court shall issue notice to the petitioner as well as complainant fixing date for conciliation and shall take all possible steps to patch up the dispute of the parties within six months from the date of issuance of the above stated notice.
