The petitioners seek regular bail in connection with Mairwa P.S. Case No. 99 of 2017, registered under Sections 272,273,308,34 of IPC and 30(A),37 (B), 41(1) of Bihar Prohibition and Excise Act, 2016.
The allegation leveled against the petitioners is with regard to recovery of Mahua liquor amounting to about 100 litres from the backyard of the petitioners.
Learned counsel for the petitioners submits that so far as petitioner nos. 2 to 4 are concerned, they are young girls and
Patna High Court Cr.Misc. No.26700 of 2017 (2) dt.13-06-2017 2/2 the petitioner no. 5 is an old lady aged about 70, who has come to her daughters' house. It is further submitted that the petitioners have clean antecedent and they are in custody since 22.04.2017. Having regard to the facts and circumstances of the case, petitioner no. 2 to 5, above named, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Siwan in connection with Mairwa P.S. Case No. 99 of 2017. In view of the fact that the huge quantity of illicit liquor was recovered from the house of the petitioner no.1, it would be expedient and in the interest of justice that the petitioner no. 1 shall be released on regular bail after completing six months of custody upon such terms and conditions as the learned court below may deem fit and proper.
