The petitioner is in custody since 27.05.2019 in connection with Mashrakh P.S. Case No. 197/2019 registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Section 30/30A/38 and 41 of Bihar Prevention of Excise Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and is alleged to be the driver of the of the Pick-Up Van and nothing has been recovered from his conscious possession.
