2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 420, 406, 467, 504, 506 and 34 of IPC .
3 . The prosecution case , in brief, is that this petitioner, who is close friend of the informant, borrowed Rs. 23,00,000/- from him on different dates for the purpose of doing business. When informant demanded the money , he refused to pay . It is further alleged that a Panchayati was also held for the same where petitioner assured to return the aforesaid amount but never returned any money and thus this petitioner cheated the informant.
4. Learned counsel appearing for the petitioner submits that
Patna High Court CR. MISC. No.53435 of 2025(2) dt.19-09-2025 2/2 petitioner is innocent and has committed no offence . Prior to the present case and for the same aforesaid alleged amount, informant has also filed Money Suit against this petitioner vide Money Suit No. 20 of 2022 i. e ,. Annexure - 5 and 6 to the bail petition . Charge sheet has already been submitted. Petitioner is in custody since 17.06.2025 .
5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Munger in connection with Safiyasarai P.
