Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Bairiya P.S. Case No. 311 of 2020 (G.R. No. 3041 of 2020) for the offence punishable under Sections 304-B/201/34 of the Indian Penal Code.

The petitioner is the husband of the deceased. Allegation is of demand of dowry and torture of the deceased. In the opinion of this Court, this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, this bail application is dismissed.

However, if the petitioner surrenders in the Court

Patna High Court CR. MISC. No.65387 of 2021(2) dt.04-04-2022 2/2 below within a period of four weeks from today and seeks regular bail, the Court below shall consider and decide the same without being influenced by this order. While deciding the matter, the Court below shall also consider the submission of learned counsel for the petitioner that some materials have come in the case diary to show that the deceased died of illness and not of torture.
