Petitioner apprehends arrest in connection with Siwan Complaint Case No. 1737 of 2019 registered for the offence under sections 323, 498A, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged and it is the opposite party no. 2 who is not desirous of living with this petitioner. As a matter of fact a Divorce Suit No. 146 of 2019 was filed by the petitioner on 01.06.2019 and after knowledge
Patna High Court CR. MISC. No.59077 of 2022(4) dt.07-04-2023 2/2 of the same in retaliation the compliant Case No. 1737 of 2019 was filed on 24.07.2019. petitioner is still ready to keep her wife with full honour and dignity. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Judicial Magistrate, Siwan in connection with Siwan Complaint No. 1737 of 2019 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
