2. Petitioner seeks regular bail in connection with Nemdarganj P.S. Case No. 8 of 2024 in a case registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.
3. Prosecution story in short is that one Sikandra Yadav owned fourteen wheeler truck bearing registration no. JH12L-5715. Allegation is that Rahul Kumar @ Chhotu contacted the informant to ply his truck. Rahul agreed to pay Rs. 1,30,000/- per month to the informant in lieu of plying the truck at the office of Amar Jyoti, Pachgaon. The truck was driven from 17.12.2023 to 31.12.2023. Thereafter he asked the informant to leave the truck at the office and asked him to come
Patna High Court CR. MISC. No.60226 of 2024(3) dt.06-12-2024 2/2 back on 03.01.2024. The driver arrived on 03.01.2024 and found that the truck was not at the place. He called Rahul who told that the truck was in Sherghati. When he received the information, he went to Sherghati in search of his truck. Thereafter the informant called Rahul @ Chhotu but he turned off his mobile.
4. Learned counsel for the petitioner is innocent and has not committed any offence as alleged and has been falsely implicated in this case. Petitioner is not named in the FIR and nothing has been recovered from the possession of the petitioner. Petitioner is custody since 01.04.2024.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Nawada in connection with Nemdarganj P.S.
