This application for anticipatory bail arises out of Ramgarh P.S. Case N0. 139 of 2019, disclosing offences under Sections 341,342,323,379,308,354,504 and 506/34 of the Indian Penal Code.
From the First Information Report, it transpires that a previous altercation is said to be the reason behind the occurrence. There is allegation that the persons named in the First Information Report assaulted the petitioners' husband by pressing his neck. They are also said to have snatched some valuables from the informant and her family members.
Learned counsel appearing on behalf of the petitioners has submitted that it is because of local dispute
Patna High Court CR. MISC. No.50848 of 2019(2) dt.16-08-2019 2/2 that the First Information Report has been got registered and there is counter case also in respect of the same occurrence which is registered as Ramgarh P.S. Case No. 140 of 2019. The injury has been found to be simple in nature.
Considering the above, this application is allowed. Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Kaimur at Bhabua in Ramgarh P.S. Case No. 139 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
