KUMAR ORAL ORDER 07-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 406, 467, 468, 471, 120B and 34 of the Indian Penal Code and 10 of the Bihar Examination Act.

It has been submitted that allegation against petitioner is that he and his associates fraudulently advertised for employment in the Merchant Navy and arrangement was made to conduct examination after taking Rs.400/- from each candidate. But in the meantime, police officials came and petitioner was apprehended. It is further submitted that petitioner has got no criminal antecedent. He has falsely been implicated in the present case due to malafide intention. Actually, examination was going on for entrance in Sea-Marine Institution, a coaching Institute, but police have wrongly interpreted the examination as a fake one. Petitioner is in custody since 02.04.2017.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
