The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

It is alleged by the informant that his sister has been killed by the petitioner being her husband by providing some medicines which were meant to increase her height which became fetal to her life. Earlier also, the in-laws family of the deceased and the petitioner used to demand dowry and for non-fulfillment of dowry

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The deceased died at her parental house. There is no allegation of any demand of dowry before the death of the deceased. From perusal of the postmortem report, it appears that no any external injury was marked on the body and viscera was preserved. The F.S.L report annexed with the case diary suggests that no poison could be detected in the body of the deceased.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Dumariaghat
