JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section395 of the Indian Penal Code. Petitioner is not named in the first information report but in would appear that one Pawan Singh @ Kailu @ Kailu Singh was caught by Kodarma Police and the aforesaid co-accused confessed his guilt and also disclosed the name of petitioner and, thereafter, the aforesaid co-accused, Pawan Singh @ Kailu @ Kailu Singh and the petitioner were remanded in this case on the prayer of I.O. of the present case. Moreover, except the aforesaid materials as well as some criminal antecedent of the petitioner, there appears to be nothing against him. However, co-accused,
Patna High Court Cr.Misc. No.12861 of 2016 (2) dt.31-03-2016 2/2 Pawan Singh @ Kailu @ Kailu Singh has already been granted privilege of bail by this court.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pakribarawan P.S. Case No. 84 of 2013 to the satisfaction of Chief Judicial Magistrate, Nawada.
