JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-08-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with regard to petitioner no. 2 as he died during pendency of the case.

2. Permission is granted.

3. This anticipatory bail application with regard to petitioner no. 2 is, accordingly, dismissed as withdrawn.

4. Heard learned counsel for the petitioners and the State.

5. Petitioner nos. 1, 3, 4 apprehend arrest in a case registered for the offences punishable under Sections 341, 323,

Patna High Court CR. MISC. No.53782 of 2025(2) dt.18-08-2025 2/3 307, 506/34 of the Indian Penal Code and Section 3/4 of the Dayan Act.

6. As per F.I.R., on the alleged date and time of occurrence, all the named accused persons, including these petitioners, assaulted informant and his wife with lathi and danda.

7. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Allegation of assault is general and omnibus. Doctor has found the injuries sustained by the injured to be simple in nature. Petitioners claim clean antecedent.

8. Learned A.P.P. for the State vehemently opposed the bail application.

9. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner nos. 1, 3, 4 in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Naugachia, Bhagalpur in connection with Naugachia P. S. Case No. 111 of 2023, subject to condition as
