In this case, the petitioner is apprehending his arrest in connection with Kotwali P.S. Case No. 688 of 2017 registered for offences under sections 143/188/166/353/504 of the Indian Penal Code.

An allegation has been made against the petitioner and others accused persons of raising slogans and forcefully interrupting the working of the office of Bihar School Examination Board (B.S.E.B.) and did not allow the employees of the B.S.E.B. to enter into the premises of the Board. The incident was taken place on 9th December, 2017 and again a case has been lodged against the petitioner

Patna High Court Cr.Misc. No.36617 of 2018(20) dt.28-06-2018 2/2 being Kotwali P.S. Case No. 116 of 2018 with respect to the same Bihar School Examination Board.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of six weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order and also taking into account that other accused persons have been granted bail by this Court, will consider the prayer for bail on the same day of appearance of the petitioner.
