Petitioner apprehends arrest in connection with Belsand P.S. Case No. 69 of 2018 registered for the offence punishable under section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel appearing for the petitioner submits that nothing has been recovered from the conscious position of this petitioner. The alleged recovery has been made from the front of the fertilizer shop with which this petitioner has no connection. Petitioner has been implicated in the present case on the statement of the co-accused person. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case
Patna High Court Cr.Misc. No.34815 of 2018(2) dt.19-06-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II Cum Special Judge, Excise Act, Sitamarhi in connection with Belsand P.S. Case No. 69 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/rahul/- U T
