The petitioner seeks bail in a case registered under Sections 420, 379/34 of the Indian Penal Code. Prosecution case, in short, is that some unknown persons, on false pretext of providing cheque of Rs.1,50,000/- for construction of house and while doing photography for the said purpose, taken away all the ornaments of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody 20.06.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His name has transpired in the present case on the basis of confessional statement of co-

Patna High Court CR. MISC. No.50981 of 2019(2) dt.16-08-2019 2/2 accused. There is no recovery of any incriminating article from the possession of the petitioner. It is case of single identification. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Kuldeep Srivastava, Judicial Magistrate, Rosera in connection with Hathauri P.S. case No.21 of 2019.
