The petitioners seek bail in a case instituted for the offences under Sections 387, 385, 504/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that the accused persons came to the house of the informant and threatened to pay ransom and when the informant open the door, he was assaulted by them.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.6.2019. Charge-sheet has been submitted in this case. There is no allegation of

Patna High Court CR. MISC. No.53344 of 2019(2) dt.26-08-2019 2/2 tampering of witnesses alleged against the petitioners. The petitioner has falsely been implicated in the present case. Due to village rivalry, the petitioner has been made accused in the present case. Other co-accused has been granted bail by the Court below vide Annexure-3 to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -II, Nawada in connection with Warisaliganj P.S. Case No. 273 of 2016.
