JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
Petitioners are not named in the first information report and for the first time, the name of petitioners came in this case in confessional statement of co-accused, Jivan Sunar but admittedly, nothing has been recovered from conscious possession of the petitioners and it appears that except confessional statement
Patna High Court Cr.Misc. No.14401 of 2016 (2) dt.07-04-2016 2/2 and criminal antecedent of the petitioners, there is nothing against them.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S.
