This is second attempt for grant of bail on behalf of the petitioner in N.D.P.S. Case No. 10 of 2016 arising out of Ara Nawada P.S. Case No. 385 of 2016 registered for the offence under Section 8/ 21(C )/ 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Earlier, prayer for bail of the petitioner was rejected on 28.11.2016 vide Cr. Misc. No. 36088 of 2016 considering the fact that there was recovery of more than 500 gm of Heroin. However , by order dated 28.06.2017 a report was called for from

Patna High Court Cr.Misc. No.26874 of 2017 (3) dt.26-07-2017 2/2 the court below regarding the stage of the case, which has been received. The report dated 3rd July, 2017 suggests that the case is pending for hearing on discharge petition.

Considering the fact that since trial is being delayed in view of pendency of discharge petition as well as recovery part, I do not find any ground to review my earlier order. The petition stands dismissed.
